GNYHA has joined other hospital associations across the nation in an amicus brief in support of a November 13 lawsuit opposing the Centers for Medicare & Medicaid Services’ recent cuts to the 340B drug program. Filed by the American Hospital Association and several other plaintiffs in the US District Court for the District of Columbia, the lawsuit argues that the 340B cuts are unlawful and exceed the agency’s legal authority. The amicus brief will describe the 340B cuts’ real-world impact on hospitals and health systems nationally—and the patients they serve. The amicus brief will be filed on December 8, the same day the plaintiffs will file their briefs supporting the request for a preliminary injunction barring the cuts from taking effect on January 1. The judge is expected to rule shortly after a December 21 hearing.
